Terms of Rental
Terms & Conditions of Van Ventures Rentals Ltd.
1.1 Fees means the fees payable by the renter to Van Ventures Rentals Ltd (the company) and as set out on the Rental Document plus any additional fees payable under this Agreement as they apply from time to time.
1.2 Rental Document means the form signed by the company and you and setting out the period and specific terms of rental to which this Agreement applies and as set out on the reverse of this Agreement (and which includes an any equivalent computerised data).
1.3 Rental Period or Hire Period means the period commencing on the date shown on the Rental Document and ending on the date that you return the Vehicle to us.
1.4 Vehicle means the vehicle described in the Rental Document (or any substitute vehicle) and includes but is not limited to its under body, parts, components, accessories and contents supplied by us (except where specifically excluded).
1.5 We, our and us means Van Ventures Rentals Ltd.
1.6 You, your and yourself means the person(s) recorded in the Rental Document as the Hirer and includes all Additional Drivers as described on the Rental Document.
1.6 References to $ or money are in Canadian currency
1.7 Unauthorized Person means any one or more of the following persons: (a) A person who is not a Hirer, (b) A person who is not licensed for the class of vehicle to which the Vehicle belongs (whether or not such person is a Hirer), (c) A person whose blood alcohol concentration exceeds the lawful percentage, (d) A person whose driver’s licence has been cancelled, endorsed or suspended within the last three years or who is otherwise on a probationary licence (whether or not such person is a Hirer), (e) A person who has held a driver’s licence for less than two years (whether or no such person is a Hirer), or (f) A person who has not inserted his or her full details on the Rental Agreement (whether or not such person was otherwise intended to be a Hirer), ‘Vehicle’ means the motor vehicle identified on the rental agreement and includes all accessories, tires and equipment affixed (permanently or otherwise) thereto or contained therein and any replacement motor vehicle, ‘You’ means the Hirer hereunder.
2. Reservation Agreement
2.1 We agree that you may hire the Vehicle subject to the terms of this agreement.
2.2 You agree to comply with the terms of this agreement and to pay the fees to us.
2.3 This agreement may only be amended in writing and its terms apply at all times during your use of the vehicle as and from when you make the reservation. Any terms and conditions contained in any other document and all statements, terms and warranties (whether implied by statute or otherwise) not embodied in this agreement are expressly excluded to the fullest extent permitted by law.
2.4 None of our employees, agents or contractors are authorised to vary or add to this agreement, make any representations about the performance, specifications or fitness for purpose of our goods other than those specified in our authorised written material.
2.5 Van Ventures Rentals Ltd. reserves the right to cancel or move bookings 14 days notice. If we are forced to cancel your booking for any reason we will refund all of your money, but not liable for any other costs associated. It is the renters responsibility to ensure they have adequate travel insurance to cover all unforeseen circumstances.
3.1 The days of pick up and drop off count as one rental day as we charge per started 24 hour period. We are closed Sundays and Canadian public holidays. Some exceptions may be considered. Pick up on first day is between 1:00pm and 2:00pm and drop off is between 10:00am and 11:00 am. There is no refund for early return. Late drop off is possible with confirmation by our staff with a maximum daily rent charge.
3.2 Extensions can be granted, but require permission from Van Ventures management. If you drop off the van at a different location that was not part of the agreement you will be charged $250 and daily rental rate.
3.3 If you fail to return the vehicle at the date and time agreed upon and without consent of an extension the vehicle will be considered abandoned or reported as stolen and reported to authorities.
4. Driver and license requirements
You and any other agree and acknowledge the following:
4.1 you and only you will drive the van unless other driver on rental agreement
4.2 you have not been convicted of, or have charges pending, for an offence relating to driving a vehicle under the influence of alcohol or drugs; or with a blood alcohol level over any legal limit, in respect of which the term of the penalty has not been fully served or served at all;
4.3 you are 18 years of age or over and hold a valid full motor Vehicle driver’s license (learners permits are not acceptable); and
4.4 You have held a full and valid driver’s licence for 1 year or more.
4.5 you have an accident free record
4.6 You have a licence issued by one of the following countries: All EU countries, Australia, Canada, New Zealand or USA. If your license is in any other language other than English or from any country previously listed you are required to obtain an International drivers license visit Canadian Automobile Association and or by filling out this attachment and submitting with fees at http://www.caa.ca/wp-content/uploads/2012/06/IDP-en.pdf
4.7 Van Ventures Rentals can refuse to provide a vehicle to any customer who is, in their opinion, unfit to drive or does not meet eligibility requirements. In such circumstances no refund will be due.
5. Use of Vehicle
5.1 You must not:
(a) allow the Vehicle to be used for any illegal or dangerous purpose, race, contest or performance test of any kind;
(b) allow the Vehicle to be used to tow or push anything, unless authorised in writing by us and unless correctly secured;
(c) carry more passengers than may be properly accommodated by the seat-belt restraints provided in the vehicle, or carry a greater load than that for which the vehicle was built;
(d) permit passengers to travel in the vehicle unless they are seated in forward facing seats and are properly restrained with the seat belts provided in the vehicle;
(e) be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in any country the vehicle is operated in;
(f) Allow the Vehicle to be used to carry passengers for payment of any kind or sublet or hire the Vehicle to any other person;
(g) Use cookers inside the Vehicle or in a dangerous manner unless equipped with cooker;
(h) Transport any animal in the Vehicle other than a Guide Dog or as agreed upon in writing and by the way of a deposit for a dog only;
(i) use the Vehicle when it is damaged or unsafe;
(j) use the Vehicle to transport goods other than those which would be reasonably contemplated in connection with the permitted purpose of the vehicle;
(k) without our prior written consent, use the vehicle to carry any inflammable, explosive or corrosive substance other than that which has been provided by us;
(l) use the vehicle in contravention of any law;
(m) use the Vehicle to carry a child without the use of an approved child restraint (as defined by Canadian or USA laws) and;
(n) take your vehicle to countries outside of Canada (USA with permission)
(o) exceed the speed limit.
6. Maintenance, Security, and Safety
6.1 you must:
(a) Maintain engine and brake oils and coolant levels if the Vehicle’s warning lights indicate that this is required;
(b) ensure that the tires are maintained at the manufacturer’s recommended pressure or as provided in the Vehicle manual;
(c) keep the vehicle locked and the keys under your personal control at all times and produce such keys if the Vehicle has been stolen;
(d) return the Vehicle to us free of all garbage and stains or subject to cleaning policy;
(e) immediately report to us any damage to the Vehicle or damage to any property caused by the Vehicle. If you do not, you acknowledge that your failure to do so may compromise your rights under this agreement;
(f) generally do all things necessary to keep and maintain the Vehicle in its current state and condition (fair wear and tear excepted); and
(g) not authorised or undertake any repairs to the Vehicle without our prior written authority except to the extent that the repairs are necessary to prevent further damage to the Vehicle or other property, in which case you must first attempt to contact us by phone to inform us of the steps you are intending to take and obtain our approval. We will only reimburse you for the cost of such authorised repairs if you keep and produce to us the original receipts for those repairs or salvage.
(h) Immediately pay or reimburse us for:
a. any damage or loss to the Vehicle or to us which is not covered by insurance.
b. windscreen, glass, headlight or rooftop breakages in addition to all other fees under this agreement unless:
6.2 Oil and water levels
The hirer/driver is responsible to check and maintain all fluid levels and must immediately rectify and report to Van Ventures Rentals Ltd. any defect of which you become aware however slight. Rectification means a fit and proper diagnosis and repair. Continued operation of the vehicle after a defect has occurred may lead to serious consequential damage to the engine for which you the renter will be held responsible and liable for full repair costs.
The risks of continued driving if your car begins to overheat, or if it has a known cooling system problem of any kind can be severe. If your temperature gauge moves in a direction that is a departure from normal, stop immediately, investigate and call Van Ventures. Do not wait for it to cool and drive again as you may cause further catastrophic damage to your engine, for which you will be held liable. Driving with an inoperative temperature gauge voids all insurance coverage and may result in the hirer being held liable if overheating occurs.
7. Driving Off-Limits
7.1 You must only use the Vehicle on sealed roads (paved) or on gravel roads that lead to provincial parks, which are roads serviced by the province of B.C.
7.2 You must not, unless authorised in writing by us, drive or take the Vehicle:
(a) On any road which is closed or restricted or on beaches or through streams, dams, rivers or floodwaters;
(b) or to any other area which we have, in our discretion, advised you not to enter
Please read our cancelation policy. When you notify our office by email or by speaking in person to one of our staff six weeks prior to reservation you are entitled to a full refund. Between five to six weeks prior to booking you receive a 75% refund. From four to five weeks prior to reservation receive a 50% refund. Receive a 25% refund from one to four weeks prior to booking date. If you cancel within one week before booking date receive no refund. Reservations are not transferable and if we don’t get a final confirmation by the way of a deposit, your booking is not valid. If our cancellation policy concerns you then you can acquire third party cancellation travel insurance.
9. Deposit & Payment
9.1 All payments must be done by cash, credit card (payment via PayPal). A deposit must be provided to us to secure the rental. Where a credit card is not available, a cash deposit can be accepted.
9.2 A deposit of 25% of the total rental cost is due to secure the rental. Total owing for the rental is due six weeks prior to rental. A bond of $500 is required for all rentals which is taken from your credit card . You authorise us to use the bond to cover insurance excess costs (and any incidental costs) as a result of any accident during the rental period. The bond amount can be deducted from your credit card (or retained from a cash deposit) if you are involved in an accident whilst using the Vehicle. The bond will be released when the Vehicle is returned provided no damage has occurred. The excess is applicable regardless of who is at fault and must be paid at the time the accident report is completed, not at the completion of the rental. The excess will be refunded to you if we are successful in recovering the costs of the damages from the third party. You acknowledge that you must pay for anything not covered by insurance or the Bond.
Vehicles come with Third Party Insurance for one driver. Each additional driver must also be covered/named on the Rental agreement. There is no extra charge for additional drivers. You are responsible for any damage that occurs to the vehicle during the period of your hire including tire and window damage. The only exception to this is if the damage is a Third parties fault and you have provided their full details to us and it is proven, by our insurers that the Third party is to blame. In incidents that involve a Third Party where liability is disputed it may be necessary for Van Ventures to take and hold the excess amount temporarily until a firm resolution is decided by the insurers. If the Third party involved is proven to be fully liable by Van Ventures Insurers the excess payment will be returned to you.
You agree to bring the van back without any garbage and with no stains, scratches, or unreasonable wear and tear. Unreasonably clean returns will be subject to a $150 cleaning surcharge.
12. Smoking & Pet Policy
Under no circumstances will you smoke inside any of our vans. This includes not smoking with the window open or van door open or smoking outside the van door with the van open as smoke travels. If smoking is detected inside the van a $500 cleaning surcharge will be payable via your credit card on file.
Regarding our pet policy. we do accept dogs, however only by permission, which includes having to pay a pet deposit and pet surcharge. The additional pet surcharge is $25 per night and a pet deposit of $100 required. If for any reason you do not pay a pet deposit and surcharge and evidence of animals were inside the van a mandatory $500 cleaning surcharge will be payable via your credit card on file.
13. Acknowledgements and Warranty
13.1 By hiring a Van Venture vehicle from us you are deemed to have accepted this agreement. This agreement is deemed to have been entered into when you request a reservation. You warrant that the information contained in the rental document is true and correct and that the credit card details provided (if any) are those of the hirer named on the rental document (not the Additional Drivers).
13.2 You acknowledge that we give no express warranty in relation to the motor vehicle other than those conditions and warranties implied by statute, which cannot be excluded, restricted or modified, such as those under the motor vehicle act of BC. Where we are permitted to limit liability under those statutes for breach of an implied condition or warranty you agree that our liability is limited to replacement, repair or re-supply of the vehicle. All other warranties, conditions and other obligations which may be otherwise implied are expressly excluded in their entirety. Van Ventures Rentals is not liable to you for any indirect, special, incidental or consequential damages relating to this agreement.
13.3 If your vehicle is unavailable overnight due to being held in a mechanical repair shop, you will be refunded for that nights hire. This only applies if the breakdown is through no fault of your own.
13.4 Van Ventures Rentals Ltd. has no liability in respect of any injury, loss or damage arising from the use of the vehicle, nor shall the company be liable for any indirect loss or damage, or, in the case of consumers, damage which was not foreseeable by both parties.
Van Ventures Rentals shall not be liable for damages arising from defects or mechanical failures which are not attributable to any breach of the manufacturer’s warranty implied by law to take reasonable care or exercise reasonable skill.
Taxes in the province of B.C. are subject to P.S.T. (provincial sales tax) of 7% and a federal tax of 5%.
15. Dispute Resolution
15.1 If you disagree with us or wish to file a complaint you agree to resolve your complaint or dispute with us by:
(a) immediately notifying the Van Venture Rentals management from which the vehicle was rented within 5 business days of returning the Vehicle by email at info @ vanventures.ca ;
(b) provide in writing exact details or your complaint together with any relevant evidence.
15.2 We will use our reasonable endeavours to provide a response to you within 10 business days of receiving your complaint;
15.3 If, upon receiving our response, you are still dissatisfied and have further queries, you must notify us in writing within 5 business days of receiving our response and we will arrange a meeting between you and us in an attempt to resolve the dispute.
Vehicle must be returned with a full tank of fuel or same amount as you picked it up ($20 surcharge for not returning the vehicle with same amount of fuel).
Always note the fuel you put into the vehicle, putting the wrong fuel such as diesel for example would result in severe damages which would be very costly to fix.
17 Theft & Loss
17.1 You must look after the vehicle and the keys to the vehicle. Loss of keys will result in a charge of $150. Van Ventures will post or courier you replacement keys but will not be liable for reimbursing any loss of hire days due to this. You must always lock the vehicle when you are not using it.
17.2 If you intend to leave the vehicle unattended for any extended period of time you must make sure it is in a secure parking area. In the event of the Vehicle being stolen or lost during the hire period you are responsible for excess regardless of any optional coverage. If it is discovered that you are negligent for the theft/loss Van Ventures Rentals will demand the full cost of a replacement vehicle and the rental agreement will be terminated immediately. Negligence includes parking the vehicle in any unsecure area for any length of time. If you are not proven to be negligent you are still responsible for the excess, however, Van Ventures Rentals will provide you with a replacement vehicle, if available, within 2 weeks of the incident once the excess payment has been received. You will be required to travel to the closest Van Ventures Rentals depot that has an available replacement vehicle at your own cost. Van Ventures will not cover the loss of any hire days in these circumstances.
17.3 Personal effects should be covered under your own personal travel insurance policy. We strongly recommend that all customers obtain the highest level of travel insurance to cover any eventualities.
18. Road side assistance
All vehicles come with emergency road side assistance. Fees may apply for callouts for human error, ex. lockout or lights left on, use outside of contracted area of use, or damage caused by negligence. Fees for excess towing and recovery may also apply at Van Ventures discretion.
